Terms Of Service
PLEASE CAREFULLY READ THESE TERMS AND CONDITIONS (“TERMS”). THIS IS A LEGAL AGREEMENT BETWEEN MINDFULL PLATE (“WE”, “THE CHEF”, "US", “OUR”, OR “THE COMPANY”), AND YOU INDIVIDUALLY, IF YOU ARE AGREEING IN YOUR PERSONAL CAPACITY, OR IF YOU ARE AUTHORIZED TO CONSENT ON BEHALF OF YOUR COMPANY OR ORGANIZATION, THE ENTITY FOR WHOSE BENEFIT YOU ACT (“YOU” OR ”THE CLIENT”). BY USING OUR SERVICES, YOU ARE AGREEING TO BE BOUND BY THESE TERMS.

The Company reserves the right, at its sole discretion, to (a) modify or update the Services and/or (b) these Terms, or its policies relating to the Services, at any time, effective upon posting of an updated version of these Terms on this website. You are responsible for regularly reviewing these Terms. If we make any material changes to these Terms, we may also send you notice thereof to the last email address you have provided to us. Continued use of the Services following notice of such changes shall constitute your consent to all such changes.
The Company will provide you, The Client, a customizable rotating menu that offers several different dishes to choose from every week. For quality control purposes, The Company asks that The Client/Chef correspondence be in writing via email, text, or website chat. Menu Planning, cooking, ingredient shopping, and clean up are included in The Client’s service. All of the agreed upon dishes are subject to change from the initial menu due to ingredient availability, quality, or other unforeseeable factors. The Chef sources ingredients based on The Client's preference sheet and submitted menu. Please inform The Chef if you would prefer them to frequent a specific store. In some cases, it is necessary to supplement ingredients from your neighborhood grocery stores.

Menu Selection: The Client agrees to select their menu by the date given by The Chef each week. If The Client fails to select their menu by the date given, The Client agrees their menu will be selected for them by The Chef. If The Client is not satisfied with the menu chosen for them, The Client should reach out to the Company via email, text or chat and The Company will do their best to accommodate any changes requested. The Client agrees they are responsible for making the correct menu selections and The Company will not be held liable if they do not choose appropriate dietary settings. If The Client makes an inaccurate menu selection and needs to re-select their menu, The Client should re-submit their menu for that week and let us know via email, chat, or text.

Scheduling: Sessions must be rescheduled within 7 days of your booking. Failure to do so will be considered a last-minute cancellation and The Client will still be billed the service fee. The Chef will arrive to The Client's home at the agreed-upon window of time on the agreed-upon session date(s). The Chef will need full access to the cooking area for an estimated 3-4 hours. Please make your home accessible to your chef on the scheduled cook-date. If for some reason your Chef is unable access your home (locks were changed, etc...) you will still be billed for your session and groceries. The Client's, children, pets and other distractions should be out of the kitchen area on all scheduled cook-dates. We respectfully request that The Client allow the Chef to perform their professional services without interruption.

Subscriptions: Clients who subscribe to the weekly meal prep plan are billed at a discounted rate of $300 per session and commit to 4 weeks of consecutive service. If The Client chooses to cancel in the middle of their subscription, The Client will still be charged for the remainder of the current subscription period. If The Client does not cancel, their subscription will remain active and they will continue to be billed until they cancel. Subscribing to weekly meal prep service guarantees The Client a designated day and time slot every week.

A La Carte Service: Clients who do not want to commit to 4 consecutive weeks of service have the option to purchase sessions a la carte at a rate of $325 + tax and groceries. A la carte sessions must be scheduled at least 7 days in advance. There is no future commitment for a la carte service, and we cannot guarantee you the same day or time slot each week. A La carte sessions cannot be cancelled and are non-refundable.

Cancellations And Rescheduling (Subscriptions): The Client agrees to provide 7 days notice if they need to reschedule a session to avoid being charged the service fee plus any charges incurred by the chef, including groceries. The client understands we cannot guarantee we will have availability to reschedule their session, and that if there is no additional availability they will still be charged for their regularly scheduled session date. The Client is allowed to skip 1 session every 3 months, after their first month of service, due to vacation or other circumstances without being charged, provided they give us 14 days (2 weeks) advance notice. Failure to give us 14 days notice will result in The Client being charged the service fee, plus any charges incurred by the chef, including groceries. Clients who have purchased a weekly meal prep subscription cannot cancel service until their subscription period ends. Should The Client choose to suspend their membership at the end of a subscription period for more than one week due to travel, we cannot guarantee availability for The Client's weekly meal prep slot upon your return without a deposit. For extended absences exceeding one week, and for continued service upon your return, we offer the option to pre-book a month of service with a 50% deposit (equivalent to two weeks of monthly service). This ensures your slot is secured upon your return, allowing for seamless continuation of sessions on your regular weekly schedule.

Groceries: The Client agrees to pay for their groceries which are invoiced separately each week. Grocery Invoices are due within 24 hours of receiving an invoice. The Client understands that groceries are shopped for by The Chef in bulk, and therefore an original receipt will not be provided with the invoice. The Company agrees to charge The Client only for their portion of groceries each week. If The Client refuses to pay for their groceries, their subscription will be cancelled and they will not be refunded or credited for any future scheduled sessions.

Home Kitchens: The Chef takes great pride in their work and agrees to respect The Client, their home and their equipment. The Chef will leave the work space as clean as they found it, remove their personal equipment, and put away all leftover groceries. The Client agrees to make sure their kitchen area is clean and ready for The Chef on the scheduled session date and that your meal containers are ready for use. If The Chef arrives to an unsuitable work space, they will document the area with a photo(s) and a cleaning fee of $50 will be added to the invoice for that service date. If the kitchen does not meet basic health code standards (i.e. no running water, no electricity, etc...) The Chef will prepare and store what they can, and The Client will still be charged their service fee.

Food Safety & Liability: Meals will be packaged and supplied with general re-heating instructions for your convenience. Although The Chef will try their best, the instructions are subject to inaccuracies due to inconsistent oven temperatures, types of equipment, etc. The Chef reserves the right to throw away food they have previously prepared if they deem it to be unfit for consumption (this may include leftovers from the previous weeks meals the chef has prepared) The Chef and The Company is not to be held liable if you choose to ignore common food safety practices by not storing, defrosting, reheating, cooking or using proper sanitation in regards to your meals. The Chef and The Company is not to be held liable for illness of any kind or allergic reaction from dishes prepared.

Invoices and Accepted Payment Options: Client's may use their credit card, apple pay, or google pay at checkout for trial plans. For subscriptions, clients will pay with their credit card as apple pay and google pay do not allow recurring payments. The Client will be sent an invoice from hello@mindfullplate.com each week with The Client's grocery bill for the week. Payment is due within 24 hours of receiving an invoice. After 24 hours of receiving an invoice, The Client will be subject to a late-fee of 10% of the total bill, per day.
